Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you”, “User”) and Izivote (“Izivote”, “we”, “us”, or “our”) governing your access to and use of the Izivote website, platform, and related services (collectively, the “Services”).

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.


1. Acceptance and Changes

Izivote may update these Terms from time to time. Updated Terms will be posted on our website and become effective upon posting. Continued use of the Services constitutes acceptance of the revised Terms.

2. Eligibility and Accounts

  • You must be at least 16 years of age to use the Services.

  • You must provide accurate, current, and complete account information.

  • You are responsible for all activity conducted through your account.

3. Nature of the Services

Izivote provides a software-as-a-service platform that enables users to create, manage, embed, share, and participate in digital polls and voting experiences, including free and paid voting options.

Izivote acts solely as a technology provider and does not review, endorse, verify, or certify polls, nominees, voters, or voting results.

4. User Content and Responsibility

All content submitted, uploaded, or displayed through the Services (“User Content”) is created and controlled exclusively by users.

You acknowledge and agree that:

  • You are solely responsible for your User Content.

  • Izivote does not monitor or pre-screen User Content.

  • Izivote is not responsible for the accuracy, legality, or appropriateness of User Content.

You represent and warrant that your User Content does not infringe any intellectual property rights, privacy rights, publicity rights, or other legal rights of any third party, and complies with all applicable laws.

5. Privacy Claims, Disputes, and Content Removal

If any individual claims that their personal data, image, name, or other content has been used in a poll or vote without proper authorization, or alleges any violation of privacy, publicity, or similar rights, such claims must be resolved directly with the account holder who created or controls the poll.

Izivote does not adjudicate ownership, consent, or authorization disputes relating to User Content and shall not be responsible for investigating or resolving such claims.

Users who create polls are solely responsible for responding to complaints, removing infringing or disputed content, and ensuring compliance with applicable laws.

Izivote may, at its discretion, restrict or remove access to content where required by law or to protect the integrity of the Services, but has no obligation to do so.

6. License to User Content

By submitting User Content, you grant Izivote a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, and distribute such content solely for the purpose of operating and improving the Services.

7. Prohibited Conduct

  • Using the Services for unlawful, deceptive, or fraudulent purposes.

  • Manipulating votes or interfering with platform functionality.

  • Impersonating another person or misrepresenting affiliation.

  • Uploading malware, automated scripts, or unauthorized scraping tools.

8. Paid Features and Revenue Sharing

Izivote may offer paid voting or monetization features. Where applicable, Izivote currently operates an 80% / 20% revenue-sharing model (user / Izivote), subject to change with notice.

Payments are processed by third-party providers. Izivote is not responsible for payment processing errors, chargebacks, or third-party service failures.

9. Privacy and Data Protection

Izivote processes personal data in accordance with its Privacy Policy and applicable data protection laws, including the GDPR and PIPEDA.

Users who collect or process personal data through the Services are responsible for ensuring lawful consent, providing appropriate notices, and complying with applicable privacy obligations.

10. Intellectual Property

The Services, including all software, designs, logos, and platform functionality, are owned by Izivote or its licensors and are protected by intellectual property laws.

You may not copy, modify, reverse engineer, or exploit the Services without prior written consent.

11. Availability and Disclaimers

The Services are provided on an “as is” and “as available” basis. Izivote makes no warranties regarding uninterrupted availability, accuracy, or fitness for a particular purpose.

12. Termination

Izivote may suspend or terminate accounts that violate these Terms or create legal, security, or operational risk.

13. Limitation of Liability

To the maximum extent permitted by law, Izivote shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of revenue, data, or reputation.

Izivote’s total liability shall not exceed the amount paid by you to Izivote in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Izivote from claims, damages, losses, and expenses arising from your User Content, use of the Services, or violation of these Terms.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the jurisdiction in which Izivote is incorporated, without regard to conflict-of-law principles.

16. General Provisions

  • If any provision is held unenforceable, the remaining provisions remain in effect.

  • Failure to enforce a provision does not constitute a waiver.

  • These Terms constitute the entire agreement between you and Izivote.
